These Terms of Use ("Terms") govern your use of rmws.com and its pages (the "Site"), which is operated by Rocky Mountain Wireline Service ("RMWS", "we", "us" or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Indemnification

You agree to defend and indemnify RMWS against any claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules.

If a dispute about the Site cannot be resolved informally, it will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, held in Mesa County, Colorado, except that either party may bring an individual claim in small-claims court, or seek an injunction in court to protect intellectual property. Disputes will be resolved individually, not as part of a class or representative action. If a dispute proceeds in court, it will be heard in the state or federal courts located in Mesa County, Colorado, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time by posting a new version on this page and changing the "Last updated" date. Your continued use of the Site after an update means you accept the revised Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site.
